5. Blockchain and Web3 Features

Our Service incorporates blockchain technology and Web3 features. By using these features, you acknowledge and agree to the following:

  • Blockchain transactions are irreversible and cannot be canceled once initiated
  • You are responsible for securing your wallet and private keys
  • We are not responsible for any loss of digital assets due to user error or security breaches outside our control
  • Blockchain transactions may incur network fees that are separate from our Service fees

6. User Content

Our Service allows you to upload, store, send, receive, and share content, including music, artwork, text, and other materials ("User Content"). You retain all rights in your User Content, but you grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, reproduce, modify, adapt, publish, translate, and distribute your User Content in connection with the Service.

You represent and warrant that:

  • You own or have the necessary rights to your User Content
  • Your User Content does not infringe or violate the rights of any third party
  • Your User Content complies with these Terms and all applicable laws

7. Prohibited Conduct

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Infringe or violate the intellectual property rights of others
  • Attempt to gain unauthorized access to the Service or other users' accounts
  • Interfere with or disrupt the Service or servers connected to the Service
  • Circumvent, disable, or otherwise interfere with security-related features of the Service
  • Use the Service to distribute unsolicited promotional or commercial content
  • Upload or transmit viruses, malware, or other malicious code

8. Intellectual Property

The Service and its original content, features, and functionality are owned by Epic Sound and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

9. Subscription and Payments

Certain aspects of the Service may require payment of fees. You agree to pay all fees and charges associated with your account on a timely basis and according to the fees, charges, and billing terms in effect at the time a fee or charge is due.

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. You can manage your subscription and turn off auto-renewal in your account settings.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

12. Limitation of Liability

IN NO EVENT SHALL EPIC SOUND, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Jurisdiction], without regard to its conflict of law provisions.
